Senator Nicole Mitchell Accused of Breaking and Entering

Charges filed, ethics complaint lodged

DFL Senator facing scrutiny

ST. PAUL, Minn. (AP) — Minnesota Senate Republicans on Wednesday filed an ethics complaint against DFL Sen. Nicole Mitchell, who was charged Tuesday with breaking into her stepmother's home to retrieve her father's ashes.

The complaint alleges that Mitchell, 47, of St. Paul, violated Senate ethics rules by engaging in conduct that "is unbecoming to a member of the Senate" and "brings discredit to the Senate."

The complaint was filed by Senate Majority Leader Jeremy Miller, R-Winona, and Senate Minority Leader Paul Gazelka, R-East Gull Lake. It comes one day after Mitchell was charged with felony first-degree burglary and misdemeanor theft in Becker County District Court.

According to the criminal complaint, Mitchell broke into her stepmother's home in rural Becker County on Aug. 10 and took her father's ashes, along with other items.

Mitchell has denied the allegations and said she will fight the charges. She has not yet been scheduled to appear in court.

The ethics complaint is now being reviewed by the Senate Ethics Committee. The committee could recommend that the Senate expel Mitchell, censure her, or take other disciplinary action.

The Senate is not scheduled to meet again until Jan. 4, so it is unclear when the ethics complaint will be taken up.
